Acceptance of the Terms

These Terms & Conditions (the "Terms") govern your use of Guess The Number Multiplayer (the "Game"), including the Android app (package com.guessthenumber.multiplayer) and the in-browser version available at https://ffdp.com.np/app/. The Game is published by FFDP, an independent game developer based in Nepal ("FFDP", "we", "us", or "our").

By downloading, installing, accessing, or playing the Game, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Game.

These Terms work alongside our Privacy Policy, which explains how we handle your data. Please read both carefully.

Eligibility & Age

To use the Game, you must be at least 13 years old. The Game is a general-audience casual game and is not directed to children under 13, and we do not knowingly collect personal information from children under 13.

If you are a minor under the age of legal majority in your country, you may use the Game only with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.

By using the Game, you represent that you meet these eligibility requirements and that you have the legal capacity to agree to these Terms.

Your Account & Username

When you first launch the Game, an anonymous guest account is created automatically. The app generates a random device identifier, stores it locally on your device, and sends it to our server to create your game account. No email, password, phone number, or real name is required to play as a guest.

If you are signed in to Google Play Games on your Android device, the Game may automatically use your Google Play Games display name as your in-game username. This is optional and uses Google Play Games Services.

Usernames are unique across the Game. You agree that your username will not:

• Impersonate any other person, player, or entity;
• Be offensive, obscene, hateful, or harassing;
• Infringe the trademark, copyright, or other rights of any third party; or
• Otherwise violate these Terms or any applicable law.

You are responsible for all activity that occurs on your account and through your device. Because guest accounts are tied to your device, you should keep your device secure. We may reclaim, change, or remove usernames that violate these Terms.

License to Use the Game

Subject to your compliance with these Terms, FFDP grants you a limited, personal, non-exclusive, non-transferable, non-commercial, and revocable license to access and play the Game for your own entertainment.

This license does not give you any ownership in the Game. You may not use the Game for any commercial purpose, and all rights not expressly granted to you are reserved by FFDP.

Acceptable Use & Fair Play

The Game is meant to be fun and fair for everyone. You agree that you will not:

• Cheat, or use any unfair method to gain an advantage in matches;
• Use bots, scripts, automation, or any software to play, interact with, or interfere with the Game;
• Exploit bugs, glitches, or errors, instead of reporting them to us;
• Manipulate or tamper with matchmaking, leaderboards, trophies, ratings, or XP;
• Harass, threaten, abuse, or otherwise engage in abusive conduct toward other players;
• Use the Game for any unlawful purpose or in violation of any applicable law; or
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Game, except where such restriction is prohibited by law.

Violating these rules may result in adjustment of your stats, suspension, or termination of your account, as described below.

Virtual Items & Trophies

The Game includes in-game features such as trophies (an ELO rating), XP, and levels. These are provided purely for in-game progression and entertainment.

Trophies, ELO, XP, and levels:

• Are in-game only and have no monetary value;
• Cannot be purchased and cannot be redeemed, exchanged, or cashed out for money or anything of value; and
• May be adjusted, recalculated, reset, or removed by us, for example to maintain fair play, fix errors, or operate the rating and leaderboard systems.

You have no ownership or property right in any trophies, ratings, XP, levels, or other in-game items.

Intellectual Property

The Game, including its software, code, design, graphics, text, sounds, gameplay, the "Guess The Number Multiplayer" name, the FFDP brand, and all related content, is owned by FFDP and is protected by intellectual property laws.

Except for the limited license granted to you in these Terms, you may not copy, modify, distribute, publicly display, create derivative works from, or otherwise use any part of the Game without our prior written permission.

Third-Party Services

The Game relies on certain third-party services to operate. Your use of these services is also subject to their own terms and policies:

• Google Play — used to distribute the Android app.
• Google Play Games Services (Google) — used for optional sign-in and to provide your in-game display name. This is governed by Google's Privacy Policy and Google's applicable terms.
• Cloudflare — provides the network/CDN/tunnel that connects the app to our server.

We are not responsible for the practices of these third-party services. The Game does not use any third-party advertising networks, analytics SDKs, or tracking SDKs.

Service Availability & Changes

The Game is provided on an "as is" and "as available" basis. We do not guarantee that the Game will always be available, uninterrupted, error-free, or secure.

We may, at any time and without liability to you, modify, update, add, remove, suspend, or discontinue any feature or part of the Game, including matches, leaderboards, daily challenges, the friends system, and ratings. We may also reset or wipe data as part of operating or maintaining the Game.

Disclaimers of Warranties

To the fullest extent permitted by law, the Game is provided without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Game will meet your requirements, that gameplay or results will be accurate or reliable, or that any defects will be corrected. You use the Game at your own risk.

Limitation of Liability

To the fullest extent permitted by law, FFDP and its developers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, loss of progress, loss of in-game items, ratings, or goodwill, arising out of or relating to your use of (or inability to use) the Game.

Because the Game is offered free of charge, to the maximum extent permitted by law our total liability to you for any claim relating to the Game is limited to the amount you paid us to use the Game, which is zero.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless FFDP and its developers from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of the Game;
• Your violation of these Terms;
• Your violation of any applicable law or the rights of any third party; or
• Content or conduct you contribute, including your chosen username.

Suspension & Termination

We may suspend, limit, or terminate your account or access to the Game, and may adjust or remove your stats, at any time if we reasonably believe you have violated these Terms, engaged in cheating or abusive conduct, or are using the Game in a way that harms other players or the service.

You may stop using the Game at any time. You may also request deletion of your account and associated data by emailing us at [email protected]; on a verified request, we will delete the game account and its associated data.

Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will continue to apply after your account ends.

Governing Law

These Terms and any dispute arising out of or relating to them or the Game are governed by the laws of Nepal, without regard to its conflict-of-laws rules. You agree to submit to the jurisdiction of the courts located in Nepal for the resolution of any such disputes, to the extent permitted by applicable law.

Changes to These Terms

We may update these Terms from time to time, for example to reflect changes to the Game or to legal requirements. When we make changes, we will update the "Last updated" date at the top of these Terms.

Your continued use of the Game after the updated Terms take effect means you accept the revised Terms. If you do not agree to the changes, please stop using the Game.
